These Terms and Conditions apply when you use the Hidden Trails website or purchase a Hidden Trails downloadable trail guide.
Hidden Trails is operated by David Byrne trading as Hidden Trails, based in Buckinghamshire, United Kingdom.
By purchasing a guide from Hidden Trails, you agree to these Terms and Conditions.
1. What Hidden Trails provides
Hidden Trails sells downloadable self-guided walking trail booklets.
Each guide contains a suggested walking route, maps and photographs of features to find along the route.
The trails are designed as leisure activities which customers complete independently and at their own pace.
Hidden Trails does not provide a guided tour or accompany customers on the route.
2. Prices and payment
Prices are shown on the website before you place your order.
Payment is taken securely through the payment services offered at checkout.
Once payment has been successfully completed, you will receive access to your downloadable guide.
3. Digital downloads and cancellation
Hidden Trails guides are digital products supplied by download.
When purchasing a guide for immediate download, you will be asked to agree that the download can begin straight away and to acknowledge that, once supply of the digital content begins, you lose your normal 14-day right to cancel the purchase.
This does not affect your legal rights if the digital content is faulty, not as described or otherwise does not meet the requirements of UK consumer law.
4. Problems with a download
If you have paid for a guide but cannot download or open it, please contact us through the Hidden Trails website.
We will try to resolve the problem by providing access to the guide again or, where appropriate, issuing a refund.
5. Changes to trails
Towns and cities continually change.
Buildings may be altered, signs and street furniture may be removed, routes may be temporarily closed and construction work or scaffolding may obscure features shown in a Hidden Trails guide.
We regularly review our trails, but we cannot guarantee that every photographed feature will always remain visible or unchanged.
If something cannot be found, customers should simply continue to the next photograph.
6. Using a Hidden Trail safely
Customers are responsible for deciding whether a route is suitable for them and for taking reasonable care while completing it.
Please remain aware of traffic, other pedestrians, road crossings, uneven surfaces, steps, weather conditions and any temporary hazards or restrictions.
Always follow road signs, pedestrian crossings, local instructions and any temporary diversions.
Never enter private property, climb structures, cross barriers or put yourself or anyone else at risk in order to find a photograph.
Everything required for a Hidden Trail should be visible from places normally accessible to the public.
Children should be appropriately supervised by a responsible adult.
Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited.
7. Route information
Maps and directions are provided to help customers follow the trail.
Although we take reasonable care when preparing and checking routes, conditions can change after a guide has been produced.
Customers should use their own judgement and follow current signs, closures and instructions encountered on the route.
8. Personal use
Your purchase gives you permission to use the guide for your own personal, non-commercial use.
You may use one purchased guide with family or friends completing the trail with you.
You must not:
- resell the guide;
- upload it publicly;
- reproduce it for commercial purposes;
- distribute copies to unrelated groups or customers; or
- use Hidden Trails photographs, maps, branding or written material to create another commercial product.
All original Hidden Trails content remains the intellectual property of Hidden Trails unless otherwise stated.
9. Maps and third-party material
Some maps used in Hidden Trails guides are based on OpenStreetMap data and are credited within the guides.
Third-party names, landmarks and other material remain the property of their respective owners.
10. Website availability
We aim to keep the Hidden Trails website and downloads available, but we cannot guarantee uninterrupted access to the website at all times.
Maintenance, hosting problems or technical failures may occasionally affect access.
If a technical problem prevents you receiving a guide you have purchased, please contact us and we will help.
11. Your consumer rights
Nothing in these Terms affects your statutory rights as a consumer.
Digital content supplied to consumers must meet the standards required by UK consumer law, including being as described and of satisfactory quality.
12. Complaints
If something has gone wrong with your purchase or you are unhappy with a Hidden Trails product, please contact us through the website.
We would much rather have the opportunity to resolve a problem directly.
13. Changes to these Terms
We may update these Terms and Conditions from time to time.
The version applying to your purchase will be the version published on the website when you place your order.
14. Governing law
These Terms are governed by the laws of England and Wales.
Nothing in this section prevents a consumer from relying on any mandatory legal rights available to them where they live.
